# Free archive footage and public-domain films

> Free archive footage: public-domain newsreels, Prelinger educational and industrial films and home movies, with year, licence and editorial flags on every clip.

Archive footage gives a video a period, a mood and authenticity that new footage can't fake: a 1950s kitchen, a wartime newsreel, a factory floor in 1938. These collections draw on the Internet Archive's public-domain and Creative Commons films, the Prelinger Archives above all, plus historic footage on Wikimedia Commons. Old footage brings two catches, which every card shows: licences set by uploaders rather than archives, and people and brands who never signed a release.

## Public domain is not the whole story

A film can be out of copyright while the people in it still have publicity rights, and the brands in it are still trademarks. Archive clips are flagged editorial for that reason: fine for documentary, education and commentary, but think twice before putting a stranger from a 1950s newsreel into an ad.

## Uploader-asserted licences

Most Internet Archive items carry the licence their uploader chose, which the Archive does not check, and some modern films are uploaded with a public-domain mark they don't deserve. Those items are capped at 'check the terms'. The Prelinger Archives are different: the collection's own curators state that the films are public domain.

## Working with old film

Archive transfers are often 480p or SD, 4:3, with title cards at the start. Pillarbox them rather than stretching, or crop to 16:9 if the framing allows. In a sequence, the builder starts long films part-way in to skip the titles.

## Questions

**Are all old films public domain?**

No. In the US, works published in 1930 or earlier are now public domain, and many later films entered it because their copyright was never registered or renewed, but others are still protected. Rely on the source's statement, and treat uploader claims as unverified.

**Why is archive footage marked editorial?**

Historic footage shows people and brands without releases. Copyright may have lapsed, but using a recognisable person to sell something can still infringe their or their estate's rights, so the flag reminds you to keep such clips to editorial uses.
